TERMS AND CONDITIONS
Harmony Brazil Tours by Bossa Nova Boot Camp Pty Ltd (ABN 55 701 369 735)
These Terms and Conditions set out the terms and conditions to apply to the tour which Bossa Nova Boot Camp Pty Ltd & Mi La Music (CNPJ 30.380.771/0001-83), (“we” or “our”) will provide as the Harmony Brazil ’27 / Musical + Cultural Tour (the “tour”) for you and all persons named in your booking (including persons added or substituted after the booking is made) (“you” or “your”).
We rely upon your acknowledgement that you have read, understood and agree to be bound by these Terms and Conditions when we accept your booking request.
We reserve the right to change these Terms and Conditions at any time prior to your booking request for a tour.
Booking
To book a place on the tour, you must complete a booking request online and provide a copy of the information page (photo page) of your passport.
We reserve the right to reject your booking request, at our absolute discretion.
If we accept your booking request, we will issue you a booking confirmation together with an invoice. You will need to pay the deposit within 7 days. We reserve the right to cancel your booking if the deposit is not paid as per the invoice.
Either the balance tour price will be due and payable, or the payment plan to pay the balance price will commence 7 days after we confirm with you that the minimum number have booked the tour.
Our legal obligation to provide the tour will arise on full payment of the tour price.
Amounts invoiced and payments made will be in Australian or USD currency. Payments must be made via a payment system such as by direct bank transfer or credit card.
The minimum number booked must reach 30 persons before the tour is confirmed. You must not book your flights until we confirm to you that the minimum number has been booked. The maximum number for the tour is 42 persons.
Prices are stated on our brochure/website. Prices stated are in Australian Dollars ($AUD) and are current at the time of publication when $1USD = approx AUD $0.71 We reserve the right to alter the itinerary and tour price at any time before or after we issue a booking confirmation. The tour price will be altered in accordance with exchange rate fluctuations between the Brazilian Real and the USD when the exchange rate drops below R$5.00 per USD$1.00. And if the AUD/USD exchange rate increases above AUD$ 0.75; we will need to review and adjust the final cost accordingly.
For security reasons, airlines and our overseas suppliers require names to be given exactly as stated in your passport. If you do not provide the correct information, then you will be responsible for any amendment or re-issue fees charged by our suppliers, in addition to our administration fees.
Services
The services we provide for the tour are:
(a) the arrangement and coordination of the tour with the suppliers; and
(b) the delivery of tour arrangements which we directly control.
The services include the significant work undertaken prior to the tour to arrange and coordinate the delivery of the tour before the tour commences.
Itinerary, tour price inclusions and exclusions
We will provide the final itinerary for the tour two months before the tour commences.
If you decide to undertake other activities during the tour not specified in the final itinerary, then you will need to book those activities directly with the activity operator. We do not accept responsibility for those activities.
The tour price includes:
Accommodation charges, activities and meals (not drinks) as per itinerary.
The Tours in each location as per itinerary.
Domestic return flights between Rio de Janeiro and Salvador (23 kg baggage limit)
The tour price does not include:
International Flights - tour participants must make their own way and pay their own way to Rio de Janeiro
Passports and Visas
Yellow Fever Shots and other vaccinations (if eligible, seek advice)
International Comprehensive Travel Insurance, Instrument insurance
Extra baggage fees; beverages with meals or at other times
Single room supplements, and hotel services directly ordered such as room service, mini bar, laundry, post, telephone, internet, Wi-Fi charges, items of a personal nature or tips
Tourist tax
Meals and drinks (other than those specified in itinerary)
Optional Activities
Musical instruments, unless specified.
Amendments and cancellations (by you)
We will endeavour to accommodate amendments and additional requests for your booking but cannot promise to fulfill them.
A request to transfer to another tour may be treated as a cancellation if we are unable to find another person to take your place on the tour.
We will charge an amendment fee to cover administration costs for amendments you request to your booking.
Amendments and cancellations must be notified in writing (by email) or may be inferred by action, such as failing to arrive for or participate in the tour..
Should you not participate in any part of the tour, no refund will be available for unused activities/services.
Should you choose to undertake optional activities or additional activities not specified in the itinerary, then you will need to book these directly with the activity operator, at your own cost. We do not accept responsibility for the acts or omissions of the activity operator or for the activities.
Cancellation, rescheduling and alternative arrangements (by us)
In these Terms and Conditions, the term Force Majeure Event means an event or events beyond our control and which we could not have reasonably prevented, and includes but is not limited to:
(a) natural disasters (including not limited to flooding, fire, earthquake, landslide, volcanic eruption), adverse weather conditions (including hurricane or cyclone), high or low water levels;
(b) war, armed conflict, industrial dispute, civil strife, terrorist activity or the threat of such acts; epidemic, pandemic;
(c) any new or change in law, order, decree, rule or regulation of any government authority (including travel advisory warnings and restrictions).
2. If in our reasonable opinion (either directly or through our employees, contractors, suppliers or agents) we consider that the tour cannot safely or lawfully commence due to a Force Majeure Event then at our discretion we may elect to either:
(a) reschedule the tour (in whole or in part); or
(b) change the itinerary; or
(c) cancel your participation in the tour (in whole or in part).
3. If in our reasonable opinion we (either directly or through our employees, contractors, suppliers or agents) consider that the tour cannot continue safely or lawfully due to a Force Majeure Event then at our discretion we may elect to either:
(a) provide other tour arrangements; or
(b) change the itinerary; or
(c) cancel the remainder of the tour.
4. If due to a Force Majeure Event we cancel the whole or the remainder of the tour, we will refund the tour price attributable to the cancelled tour arrangements less:
(a) unrecoverable third-party costs and other expenses incurred by us for the cancelled tour arrangements;
(b) administration charges incurred by us relative to the price of the cancelled tour arrangements; and
(c) fair compensation for work undertaken by us in relation to the cancelled tour arrangements until the time of cancellation and in connection with the processing of any refund.
5. If we cancel the whole or the remainder of the tour, our contract with you to provide the tour will be at an end.
6. Other than the rights and responsibilities set out in these Terms and Conditions, and subject to the Australian Consumer Law, if the change or cancellation is due to a Force Majeure Event, we will be responsible for provision of rescheduled tour arrangements, changed tour arrangements, other tour arrangements, changed itineraries or cancelled tour arrangements.
7. Refunds for cancellations by us, irrespective of when the cancellation has been communicated, cannot be provided to you until our supplier has released the funds to us. This may take time.
8. We may make changes to the itinerary, modes of transport, accommodation and the inclusions due to local circumstances beyond our reasonable control, such as road conditions, poor weather, changes in transport schedules, and/or vehicle breakdowns occurring prior to the commencement of the tour or during the tour. If so, we will notify you as soon as practicable and will try to put in place alternative arrangements for your benefit, which are acceptable to you. We will pass on any extra costs incurred.
Travel Insurance
You must take out personal travel insurance which provides comprehensive cover for all activities and eventualities that may occur in the tour.
We recommend you take out the travel insurance when we provide the booking confirmation, so that you have cancellation cover.
The travel insurance should include cover for cancellation, medical and dental expenses, repatriation, evacuation, loss and damage to baggage, public liability and loss of documentation. If you intend to engage in adventurous activities, the travel insurance policy exclusions should not exclude cover for those activities.
We strongly encourage you that when you purchase travel insurance, you ensure that it adequately responds to cancellation and rescheduling risks associated with Force Majeure Events.
Monitor the travel insurance with your travel insurer to be aware if the travel to Brazil is affected by DFAT travel Advice - Level 3 advice / Reconsider your need to travel or Level 4 advice - Do not travel.
Safety, illness and vaccination
If due to any illness, suspected illness or failure to satisfy any required tests (such as a PCR or rapid antigen test in relation to Covid-19) or country specific vaccination requirements:
• an airline or other transport provider refuses you carriage; or
• a hotel refuses to accommodate you; or
you are denied entry into Brazil; or
we or our suppliers (acting reasonably) are unable to commence or continue your participation in the tour;
Then:
• if you have not commenced the tour, we will treat it as an amendment request by you; or
If you have commenced the tour, we will provide you with reasonable assistance to arrange alternative travel arrangements, at your cost.
2. If you take prescription medication it is important to carry a signed declaration by your doctor outlining your need to have this medication in your possession. Please note: some medication is illegal to bring into Brazil with or without a signed declaration from your doctor. It is your responsibility to make the relevant enquiries with your medical practitioner and we take no responsibility for any penalties that you may incur for not following this advice.3. You must inform us and the providers of tour arrangements of any medical conditions which may affect your ability to participate in the tour.
4. We reserve the right to cancel your booking or end your participation in the tour if any undisclosed medical conditions mean that you will require special assistance from our personnel which we cannot reasonably provide. We will not be liable for any damage, injury, death or loss of any kind arising from undisclosed medical conditions.
Dietary Requirements
Special dietary requests must be notified to us at the time of booking. Although we will use reasonable endeavours to accommodate requests, we cannot guarantee requests will be met by our suppliers. It is your responsibility to check that meals and beverages do not contain any allergens. We expressly disclaim any liability for meals or beverages that contain allergens.
Passports and Visas
It is a requirement that you hold a valid passport and any required visas for the tour. Your passport must have an expiry date of at least 6 months after the date of your expected return to Australia.
It is your responsibility to ensure that you are in possession of the necessary documentation to comply with the laws and regulations for entry to Brazil. You must obtain the required visa as outlined on the website prior to departure. A Tourist Tax may be payable. All costs associated are your responsibility.
Authority on Tour
When joining a group tour, you undertake to conduct yourself in a manner conducive to good group dynamics. If you act in a manner that threatens or disrupts the safety or enjoyment of others on the tour, the tour leader may, acting reasonably, require that you leave the tour. You will not be entitled to any refund for unused services and you will be responsible for any additional costs you incur.
Fitness To Travel Declaration
On a Harmony Brazil Tour, we pride ourselves on our ability to create unique, once in a lifetime small group tours that are filled with incredible experiences you might not be able to have on your own, or in a larger group. However, that does mean aspects of our itineraries can be challenging for some travellers. We want to make sure all travellers enjoy the tour, not struggle through it.
The tour arrangements require that you are able to safely:
Walk for moderate periods on pathways and places that could be steep and uneven at times
Occasionally walk-up flights of stairs and short hills
Stand for extended periods of time
Carry luggage
Get on and off various modes of transport without assistance
Responsibility
Where tour arrangements and services are supplied by independent suppliers, you acknowledge that our responsibility is limited to taking reasonable steps to select reputable independent suppliers and arranging for them to provide tour arrangements to you. Independent suppliers include but are not limited to transport providers, accommodation providers, and activity providers.
To the fullest extent permitted by law, we will not be responsible to you or be liable for any loss, damage, personal injury or delay attributable to the actions or omissions of an independent supplier. Any claims you have in this regard must be made against the independent supplier. You acknowledge that the independent supplier’s liability to you may be limited by their own terms and conditions.
We are not responsible for any other activities or excursions which are not included in the itinerary. Any advice or recommendation made by a guide, another tour participant, or local representative relating to an additional itinerary does not make us responsible.
You must sign a Liability Waiver in which you acknowledge that you have been warned the activities carry with them potential risks including the risk of injury, disability, illness or death, and other damage to my person, and loss of or damage to property and freely and voluntarily accept and assume all risks of participating in the activities.
Acceptance of Risk
You acknowledge and accept that the tour involves personal risks which may be greater than those present in your everyday life. The risks could be as a result of the adventurous nature of your tour activities or the visiting of destinations which present geographical, political or cultural risks and dangers.
The risks present in the destination and places in the itinerary are described in the guidance provided by the Department of Foreign Affairs and Trade (DFAT). You acknowledge that your choice to travel is made having had the benefit of that guidance, and you accept any additional personal risks associated with your travel.
General Liability Limitation
To the extent only that we are the principal supplier to you of tour arrangements or other activities which we control, then we will provide those travel arrangements and activities with reasonable skill and care. We will be responsible for our employees in the course of their employment, and for our agents and suppliers who are providing activities as we requested.
We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, or any other third party not connected with the provision of the tour arrangements or activities.
We will not be responsible for any loss or additional expenses you incur for any missed connections/activities attributable to delays in scheduled arrival or departure times, which are outside of our control.
Images
When on tour, we may take photographs, videos or make recordings of you and your activities that identify you. We reserve the right to use any images and/or recordings for promotional and marketing purposes. You consent to this use on a royalty free basis. If you do not consent to the use of your image or likeness, please advise us at the start of your tour, and in any event before images are photographed or videoed.
Authority
If you place a booking on behalf of another person, you represent and warrant us that you are duly authorised to provide the agreement and consent of the other person to be bound by these Terms and Conditions.
General
The contract between us and you is governed by the laws of the State of Victoria. Any disputes shall be dealt with by a court with the appropriate jurisdiction in Victoria.
If any provision of these Terms and Conditions is found to be unenforceable, then to the extent possible it will be severed without affecting the remaining provisions.
Any personal information you provide to us will be collected, stored, used, protected and shared in accordance with Australian Privacy Principles.
